Terms of Service

Welcome to Qonvo. These Terms of Service ("Terms") govern your access to and use of Qonvo's communication coaching application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

By creating an account or using Qonvo, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

4. Service Description

4.1 What Qonvo Provides

Qonvo is an AI-powered communication coaching platform that:

• Provides practice scenarios for improving communication skills
• Analyzes your speech and conversation patterns
• Generates personalized feedback and coaching recommendations
• Tracks your progress over time
• Offers multi-language support

4.2 AI-Generated Content

Qonvo uses artificial intelligence (Google Gemini) to:

• Analyze your speech and conversation
• Generate coaching feedback
• Provide personalized recommendations

5. Acceptable Use

5.1 You May Use Qonvo To:

• Practice and improve your communication skills
• Receive personalized coaching feedback
• Track your progress
• Use in personal or professional development

5.2 You May NOT:

• Share your account with others
• Use the Service for illegal purposes
• Attempt to reverse engineer, decompile, or hack the Service
• Upload malicious code, viruses, or malware
• Spam, harass, or abuse other users or our systems
• Scrape, crawl, or extract data from the Service
• Use the Service to generate content for commercial purposes without permission
• Impersonate others or provide false information
• Violate any applicable laws or regulations

6. Intellectual Property Rights

6.1 Qonvo Ownership

Qonvo and its content (excluding your user content) are owned by us and protected by copyright, trademark, and other intellectual property laws. This includes:

• Software, code, and algorithms
• User interface and design
• Scenario content and prompts
• Branding, logos, and trademarks
• AI models and training data

6.2 Your Content

You retain all rights to your user content, including:

• Your recordings and transcripts
• Your personal information
• Your practice session data

6.3 License Grant

By using Qonvo, you grant us a limited, non-exclusive license to:

• Process your recordings and transcripts to provide coaching feedback
• Store your data securely on our servers
• Use anonymized performance metrics (with your consent) to improve our AI

Important: We do NOT claim ownership of your content. This license only allows us to provide the Service to you.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We store your recordings and transcripts securely
• We never share your personal data with third parties
• Anonymized data sharing requires your explicit consent
• You can delete your account and all data at any time

8. Payment and Subscriptions

Qonvo currently offers a free tier with limited features. We reserve the right to modify, limit, or discontinue the free tier at any time with reasonable notice.

If we introduce paid subscriptions in the future:

• Subscriptions will auto-renew unless canceled

9. Disclaimers and Limitations

9.1 Service "As Is"

Qonvo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy, reliability, or completeness of AI-generated feedback
• Uninterrupted or error-free service
• Specific results or improvements
• Fitness for a particular purpose

9.2 No Professional Advice

9.3 AI Limitations

You acknowledge that:

• AI-generated feedback may contain errors or inaccuracies
• Speech recognition may not be perfect
• Analysis quality depends on audio quality and clarity
• AI cannot replace human judgment and expertise

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Qonvo, its owners, employees, and service providers SHALL NOT BE LIABLE for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from use or inability to use the Service
• Damages from reliance on AI-generated feedback
• Damages from data breaches or unauthorized access

Our total liability to you for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 (whichever is greater).

11. Indemnification

You agree to indemnify and hold harmless Qonvo, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your user content

12. Third-Party Services

Qonvo integrates with third-party services:

• Google Cloud Platform: Hosting and infrastructure
• Google Gemini AI: Speech analysis and coaching
• Firebase: Authentication and database

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services.

13. Termination

13.1 By You

You may terminate your account at any time by:

• Going to Settings → Privacy & Data → Delete My Account
• Contacting us at support@harbor-ai.com

Upon termination, all your data will be deleted within 30 days.

13.2 By Us

We may terminate or suspend your account immediately if:

• You violate these Terms
• Your account is inactive for over 2 years
• We discontinue the Service (with reasonable notice)
• Required by law or regulation

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute, please contact us first at support@harbor-ai.com. We will attempt to resolve the issue informally within 30 days.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except:

• Small claims court disputes
• Intellectual property disputes
• Disputes in jurisdictions that prohibit arbitration

14.3 Class Action Waiver

You agree that disputes will be resolved individually, not as part of a class action or collective lawsuit.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

For users in the European Union, you retain the protection of consumer laws in your country of residence.
